A federal judge in Delaware has rejected US biotech company Moderna’s argument that the US government’s license to patents arising from federally funded research protects the company against Northwestern University’s patent allegations.
The dispute concerns lipid nanoparticle technology used in, among other things, the COVID-19 vaccine Spikevax. The court has not yet ruled on the actual infringement allegations or certain other defenses raised by Moderna.
